Odin Law and Media Files Amicus Brief with U.S. Supreme Court Supporting Digital Privacy in Trademark Applications

Firm challenges US Patent and Trademark Office’s privacy-compromising requirement for domicile addresses

Raleigh, NC – 16 July 2024 – Odin Law and Media (OLM), a leading firm specializing in digital media and game development law, is proud to announce its representation of the International Game Developers Association (IGDA) and CodeMiko in filing an amicus brief with the United States Supreme Court.

The case, Chestek PLLC v. Vidal, challenges the US Patent and Trademark Office’s rule requiring all trademark applicants to provide their domicile addresses when applying for trademark registrations.

Odin Law and Media argues that this requirement unnecessarily exposes applicants, particularly those in the games and digital entertainment industries, to risks of harassment and invasion of privacy. The brief asserts that the USPTO’s rule endangers individual privacy and skips crucial steps that should allow the public to help shape the rules that affect them.

“Ensuring that administrative bodies engage in fair notice-and-comment rulemaking is fundamental to the democratic process,” stated Brandon J. Huffman, founding attorney at Odin Law and Media. “This case highlights a failure to provide adequate notice or solicit meaningful input from those most impacted by the rules, particularly affecting individuals in the digital entertainment and game development sectors where privacy concerns are paramount.”

“Transparency and protection of personal information are critical in the digital age,” added Jakin Vela, executive director of the IGDA. “The requirement to disclose domicile addresses without adequate safeguards fails to recognize the unique risks faced by creators in the digital space, like game developers who are particularly vulnerable to doxing and other forms of harassment.”

The brief elaborates on the significant privacy concerns for individuals in the creative industries, emphasizing that many small business owners, developers, and digital entertainers use their home addresses as their business addresses, making them easy targets for harassment.

Odin Law and Media’s filing on behalf of IGDA and CodeMiko underscores the firm’s commitment to advocating for sensible digital privacy protections and supporting the game development community in legal matters that affect their professional and personal lives.

2v8, Cross-Progression, and Lara Croft Arrive in Dead by Daylight 

It’s a big month for the Dead by Daylight universe with major updates coming to The Fog, as well as the official release date reveal of The Casting of Frank Stone.

MONTREAL – July 16, 2024 – Hot on the heels of a jam-packed Eighth Anniversary Broadcast, Dead by Daylight continues to pick up speed. On deck this month is the release of even more game-changing content and news that tees up a singular summer for the hit horror multiplayer. Beginning today, fans can step into the boots of gaming’s ultimate survivor as Lara Croft enters The Fog, followed closely by the massive additions of Cross-Progression and the new 2v8 Game Mode less than a week later. The Casting of Frank Stone also breaks news with the reveal of its upcoming release date and the opening of pre-orders for both its Deluxe and Standard Editions.

Dead by Daylight x Tomb Raider

Prepare to venture into the unknown as the Tomb Raider herself, Lara Croft, takes on The Entity’s Realm. Courageous, resourceful, and no stranger to the supernatural, few characters enter Dead by Daylight with the Tomb Raider’s iconic status or survival pedigree.

While she may find herself without her trademark pistols or bow, Dead by Daylight’s gameplay boils Lara down to her essence, creating abilities around the intangibles that define her. Lara introduces 3 new Perks, Finesse, Hardened, and Specialist to Dead by Daylight, each of which underscores her skills as an athlete (new animation!), adventurer, and archeologist respectively.

2v8 Mayhem Arrives

If you think you know Dead by Daylight, think again. The highly requested 2v8 Game Mode arrives on July 25, injecting the familiar player experience with a big dose of chaos, fast-paced action, and added fun.

With more than a few surprises still up their sleeves 8 years in, the Dead by Daylight team has shaken up the standard Trial in a major way. For the first time ever, 2 Killers can team up to hunt 8 Survivors, delivering a fresh and frantic take on gameplay for seasoned players.

2v8 Trials will take place across 5 classic Maps, each of which has been expanded to house the action. Generators have also been doubled, with Survivors now needing to repair 8 of 13 to escape. Hooks and Perks have been jettisoned in a bid to keep the action flowing. Downed Survivors are now sent directly to Cages, while Survivor Perks are replaced with a new class system designed to encourage teamwork as players can adopt clearer “roles” within a Trial. Instead of Classes, Killers will receive alterations to their Powers, as well as a crucial team-based ability to amplify the havoc they can wreak as a duo. 

Dead by Daylight has its party mode, and it’s available for a limited time from July 25 to August 8.

Cross-Progression, Coming Soon 

Available on July 22, Cross-Progression is coming to Dead by Daylight allowing players to sync their progress and purchases across platforms.  

A huge quality of life of improvement for those who enjoy Dead by Daylight on multiple platforms, Cross-Progression has been a long-requested feature which the team is excited to deliver on. All players need is a Behaviour Account, and to own the base game on whichever platforms they wish to play. To help streamline the process an easy-to-follow “How-To” video will walk players through the simple steps of getting set up. The Casting of Frank Stone Release Date

The world of Dead by Daylight continues to expand with The Casting of Frank Stone, set to officially release on Sept. 3, 2024.

Supermassive Games and Behaviour Interactive’s collaboration spins a disturbing single-player cinematic yarn from Dead by Daylight’s lore, offering a completely new window into the game’s universe.

Standard and Deluxe Editions of the game are now available for pre-order. Aces of Thunder, a new VR flight simulation game, is aiming for Q4 2024

The game will be available for PlayStation and Steam

Gaijin Entertainment announces that Aces of Thunder, a new flight simulation game primarily focused on combat in VR, will be available for purchase in Q4 2024. In addition to the previously announced PlayStation 5 version, a Steam version is also on the way. Both are already available for wishlisting on their respective platforms, the price and exact release date will be announced later.

Aces of Thunder is a spin-off of the popular online game War Thunder, and this new title is focusing solely on aerial battles of legendary aircraft in the most iconic theaters of war. More than twenty meticulously recreated models will be available to players at launch. The roster includes the American P-51 Mustang and P-63 Kingcobra fighters, the German Bf 109 and Fw 190 fighters, the Soviet IL-2 attack aircraft, the British Spitfire fighter and the Japanese A6M3 Zero. You can admire both the interior and exterior of these beauties, i.e. while walking around them on the airfield, as well as during flight, which the player experiences exclusively from the cockpit, you can quite literally grab the controls with your hands and spin a turn.

“From the very beginning we focused mainly on VR-specific ergonomics and the immersive flight experience achievable with modern hardware. To reach these goals we have rewritten and optimized the VR-subsystem of the Dagor Engine (some of these improvements can be seen in War Thunder already, a game that uses the same engine), – says Vladimir Dranyonkov, game director of Aces of Thunder. – We have re-evaluated our approaches to user interactions along with audio and visuals, so familiar from our previous experience with War Thunder. We also worked on addressing common comfort issues without harming the simulation aspect of aerial combat. This, we hope, will attract new pilots to our virtual skies.”

Battles will take place on 15 maps representing three key theaters of operations: the Eastern Front, Western Europe and the Pacific Ocean. You can fight both online with other players and in single-player scenarios; alone or in squads with friends. Two dozen iconic aircraft are available immediately after purchasing the game. Thanks to the native support for the OpenXR standard, Aces of Thunder is compatible with the widest range of VR devices. To directly control the aircraft, players can use the interactive virtual cockpit controls, gamepads, VR controllers or joysticks.
